Hox 101 <br />Glenwood Springs, Colorado 81602-0101 <br />RE: MLRB order concerning Pueblo Coal <br />Dear David: <br />This is to assure you that the Mined Land Reclamation Division <br />remains ready and willing to work with Pueblo Coal to resuscitate <br />Pueblo Coal's application for permit renewal. <br />As you are aware, the Hoard has denied the renewal and forfeited <br />the bond. The Division sought denial of the renewal application <br />in order to aggressively pursue its claim on the letter of <br />credit. However, like any administrative agency, the Hoard has <br />the authority to reconsider its action and vacate its order. If, <br />by August 20, 1990, Pueblo Coal submits a replacement bond in the <br />amount of $1,125,300, and provides all necessary information <br />requested by the Division, the Division will wholeheartedly join <br />Pueblo Coal in a motion for reconsideration. <br />I think you are aware that the Board would be quite pleased to <br />entertain a motion for reconsideration. Both the Board and the <br />Division recognize that it would be in the best interests of all <br />concerned to resolve the outstanding matters and renew Pueblo <br />Coal's permit. I sincerely hope that we can reach such a favor- <br />able conclusion to this matter. <br />I have enclosed my final draft of an order.
