Based on the authority conferred to the U.S. Fish and Wildlife Service (Service) by the Endangered
Species Act of 1973 as amended (16 U.S.C. 1531 et sue.), the Service reviewed the Ute ladies'-tresses
orchid (Spiranthes ctilarvialis) survey report for I3a(T-Irwm's proposed Benilrardt Resource Project in
Weld County Colorado (Townshi 4 North, Range 67 West, South''/z 1 . The proposed project site ~s
bounded on tie north by the Big Z~ompson River on the east by Weld County Road 25, on the south by
Weld County Road 48, and on the west by Weld County Road 23.
The Service finds the habitat assessment report acceptable and agrees that although suitable habitat for S.
diluvialis is present in some areas, no individuals or populations of the orchid were located. Therefore,
the Service concurs with the determination that the proposed project is not likely to adversely affect the
continued existence of the orchid.
