Burgmaier: <br />We have completed our review of Seneca Coal Company's (Seneca) <br />Yoaet Mine Permit Application Package (PAP). The PAP was reviewed <br />for the following: <br />Compliance with special lease stipulations and apencv reaulatione. <br />No compliance problems were identified with the special lease <br />• stipulations. <br />(a) cultural resource inventories are included and proper on-going <br />consultation documented. <br />(b) Paleontological resources are not addressed in the mine plan <br />specifically, however, the federal lease stipulation adequately <br />identifies measures to be taken in case of discovery of fossils <br />during operations. No conflicts between the lease and mine plan <br />were identified. <br />(c) No surface disturbance is proposed in the area identified on the <br />lease as Fragile Soils. <br />Analveie of lands unsuitable for surface mining and reclamation pursuant <br />to 43 CFR 3461. <br />Through our land use planning process, none of the lands contained in <br />the affected federal lease COC088199 have had unsuitability applied. <br />Unsuitability criteria were applied to the lands added to lease <br />COC0114093 prior to lease modification. Pursuant to 43 CFR 3461.3-2 we <br />do not apply unsuitability criteria to leased lands. No unleased <br />Federal lands are proposed to be affected by mining within the mine <br />permit area. <br />Conflfcta between poet-mining land uses and exiatina BLM land manacement <br />plane and policies. <br />Seneca has addressed our concerns under this heading.
