E~~A <br />S Coal Company <br />Seneca Coal Company <br />SAMPLE LETTER <br />Dear Homeowner: <br />June 5, 1995 <br />Seneca Coal Company has submitted a Mining and Reclamation Permit <br />Application to the Colorado Division of Minerals and Geology for <br />the proposed Yoast Mine located approximately seven miles southeast <br />of Hayden (see attached map). <br />Under Section 2.07.6(2)(d)(v) of the Rules and Regulations of the <br />Colorado Mined Land and Reclamation Board, the owner Of any <br />occupied dwelling within 300 feet measured horizontally from the <br />permit boundary must provide a written waiver consenting to surface <br />coal mining operations closer than 300 feet. On Exhibit 12-1, <br />Operations Plan, Sheet 2 of 2, your home falls within this <br />category. Under the current mining plan estimate, mining will not <br />• take place in this vicinity until the five-year permit term of <br />2005-2009. A sedimentation pond is also planned for construction <br />within this 300 foot area. A complete copy of the Permit <br />Application Package (PAP) is available for your review at the <br />Hayden Public Library, the mine office, and the Colorado Division <br />of Minerals and Geology, 1313 Sherman Street, Denver. <br />Enclosed is a waiver for your signature, stating that as owner and <br />signator you have the legal right to deny mining and knowingly <br />waived that right. The regulations also state that the waiver must <br />be separate from a lease or deed unless the lease or deed contains <br />an explicit waiver. <br />If you consent to allow surface coal mining operations within this <br />300 foot zone, please sign and return the enclosed waiver form by <br />June 15, 1995.
