FROM : FRX NO. 17198464975 Nov. 10 2005 10:16pM P2 <br />A listing of ail facilities and structures to be ultimately removed at the New Flk Mine can <br />be found in Exhibit 28, Band Calculations. Picketwire Processing plans to salvage all <br />iron and steel scrap which is of value within these structures and remove them from the <br />mine site. Materials which can not be salvaged Bach as'concrete and rcbar, insulation, <br />and non-recyclable steel and metal siding will be disposed of on-site within the mine <br />disturbance area. A minor amount of structural wood products may also be included. <br />Las Animas County officials refenxd PPLI.C to the Colorado Department of Public <br />Health and Environment (CDPFI&E). Solid waste disposal is regulated by (CDPH&E) <br />and requires a certificate of designation for each solid waste disposal site. However the <br />CDPH&E Web-site stated and CDPH&Ii personnel confirmed that for any person or <br />otber non-governmental unit disposing of one's own waste oa one's own surface is <br />exempt from thax requirement provided that the site complies with State regulations and <br />is not a public nuisance. For mine related activities these activities are regulated through <br />the Division of Minerals and Geology mine permitting process. <br />Disposal areas are shown on Map 15 -Surface Aistnrbance/Post Mining land Use <br />East Por'la1 and Map 16 -Surface 1)isturbance/Post Mining Land Use West Portal. <br />Each disposal site will comply with Section 4.11.4, and will be located to ensure that <br />leachate and surface runoff do not degrade surface or ground water, $res are prevented <br />and that the area remains stable and suitable for recLwrafion conopatible with the natural <br />surroundings. Waste material buried on-stite will be compacted and coveted with a <br />minimum of two foot of soil medium <br />The coal lab and ambulance garage are sound structures and suitable for such post mining <br />uses as an office and storage facility for land management. As such, the surface owner, <br />PPLLC, has requested their retention as apost-mining facility. <br />Sediment cormol structures and surface drainage ditches which arc required to route <br />water to the sediment ponds will be left intact during the revegetation period The <br />purpose for leaving the ponds .intact will be to meet the requirements of Rule 4.05.6(9), <br />Alter vegetation has been established sufficient to control erosion, PPLLC plans to <br />remove the sediment ponds. <br />(b) ReclamatYon cost Estimate <br />A detailed reclamation cost breakdown is provided is Exhibit Zti -Bonding <br />Calcnlaiion, for the New Elk Mine. Costs are provided for removal and reclamation of <br />all facilities at the New EIk Mine. <br />(c) Backfrlling and Grading <br />Map 17 -Post Mining Topography and Cross Secfions, shows the approximate final <br />stuEace configuration for the New Elk Mine facitities. .Map 17 shows the post mining <br />topography and cross sections in the West Ports) and East Portal areas.
