Dear Mr. Hoffman:
We are responding to your written request for comment on the
Conditional Use Application for the Highway 50 Borrow Area #2,
submitted by Elam Construction. The project is.located adjacent
to Kannah Creek within Section 32, Township 2 South, Range 2
East, Mesa County, Colorado.

Based on a site inspection by Mr. Randy Snyder of this
office on June 28, 1999, we determined that the proposed mining
area does not contain jurisdictional wetland. Therefore a
Department of the Army permit will not be required for this
project. However, waters of the United States (Kannah Creek),
including adjacent wetlands do exist adjacent the permit boundary
to the south. The permit boundary should be clearly marked in
the field to avoid any incidental impacts to the riparian area or
wetlands associated with Kannah Creek.
