~7 <br />DII DI~~IDDI~~~~~ ~I~ <br />EXHIB:[T A - Legal Description <br />• <br />That portion of the SE 1(4 of Section 21, T7N R43W of the 6th P.M. in <br />Phillips County Colorado which lies within the confines of the banks of the <br />Frenchman Creek. Said portion of the SE 1/4 will contain approximately 9.9 <br />acres. <br />EXHIB]T B - Mining Plan <br />Access is currently available from Phillips County Road No. 18. A <br />roadway already exists, as this area has been mined previously. This road <br />will be left in place when the pit is closed. <br />Sand and gravel will be mined within the confines of the banks of the <br />creek bed beginning at the south edge of the creek and proceed north and <br />west approximately in the middle of the quarter. Excavation will continue <br />as gravel is needed for local road operations and as the supply remains <br />available. Gravel could be mined as deep as 20 feet. Most of the mining <br />will go no lower than 10 - 12 feet in depth. <br />Some stockpiling may be done at the site, but mast of the gravel will be <br />utilized as it is mined. Any stockpiling that does occur will parallel the <br />creekb~ad and be along the south side of the flow area as this area has been <br />used for stockpiling in the past. The stockpile area will not be stripped <br />because there is no topsoil there currently. <br />The pit will continue to operate annually. The supply is undetermined, <br />but it is expected to last indefinitely because of the limited use of the pit. <br />The equipment to be used in the pit area will be a dozer, front end loader, <br />and trucks. <br />
