The holder shall be fully liable to the United States for any damage or <br />injury incurred by Che United States in connection with the use and <br />occupancy of Che right-of-way area by the holder, it's employees, <br />contractors, or employees of the contractors. <br />6. The holder shall fully indemnify the United States for liability. damage or <br />claims arising in connection with Che holder's use and occupancy of the <br />right-of-way area. <br />7. In the construction, operation, and maintenance of the facilities authozized <br />by this great, the holder shall not discriminate against any employee or <br />applicant for employment because of race, creed, color, sex or national <br />origin. All subcontractors shall include an identical provision. <br />Special Stipulations <br />1. The holder shall conduct all construction, operation, and maintenance <br />activities in a manner that will minimize disturbance to soils and <br />vegetation. Construction and maintenance methods shall be designed and <br />performed to limit soil erosion and subsidence and protect air and water <br />quality. <br />2. This right-of-way is being issued subject to valid existing rights which <br />include a grazing permit. The right-of-way holder will be required to <br />take such action as prescribed by the authorized officer, BLM, to avoid <br />conflicts or problems with pre-existing authorized users of the public <br />lands involved in this right-of-way. This will require replacement of <br />the existing gate at the highway with a cattleguard. <br />3. The 'holder will contact the San Luis Resource Area Manager (589-4975) at <br />least five (5) working days prior to beginning construction of the new <br />segment of road authorized by this grant. <br />4. This right-of-way grant authorized construction of a new road (18 feet <br />wide, graded, with aggregate surface) over the existing segment of jeep <br />trail (approximately 1600 L.F.). Approximately a 15 foot strip of natural <br />vegetation will remain between the north side of the road and the existing <br />fenc~a along the north border of the public land to allow for construction <br />of water turnouts. Routine maintenance activities, including grading, of <br />the iiew road segment is permitted. All road construction and maintenance <br />will be confined within the limits of the 24 foot wide right-of-way, <br />unless otherwise approved in writing by the authorized officer. <br />5. The holder will construct approximately five (5) water turnouts at the <br />same locations of the existing waterbars on [he jeep trail. The water <br />turnouts will be constructed to the specifications of the authorized <br />officer (or his designated representative), so that they will drain <br />free.Ly onto natural ground level and into the natural vegetation. If <br />eros:[on problems do occur, the holder will be responsible for correcting <br />these problems to the satisfaction of the authorized officer or his <br />authorized representative. <br />
