LOnp <br />D rvia on Dueaor <br />RE: Appraisal for Deed of Trust and Financial Warranty for <br />Permit # M-77-011, M-77-153, M-77-526, M-78-255, M-78-279, <br />M-79-165, M-81-096, M-81-202SG, M-81-231, M-83-033, and M- <br />86-079: <br />Dear Mr. DeFord: <br />After our telephone conversation of 8/11/93, it occurred to me <br />that it might be helpful for you to have an outline of the <br />Division's specific needs and concerns, which I am now providing <br />to you. <br />we would request that the following items and questions be <br />addressed in your property appraisal: <br />1. Provide proof of transferability of any applicable use <br />permits or that the current county zoning allows for <br />mining. <br />2. Document the total recoverable yards of aggregate that <br />are the basis for the claimed value, with the following <br />considerations: <br />A. Provide documentation that if the site was to be <br />mined, reserves would not be sterilized due to the <br />provisions of CRS 34-32-115 (d) and (f). If <br />reserves could be sterilized, please provide an <br />analysis as to the affect on the appraised value. <br />B. Document the ground water level. The value of the <br />reserve should be determined for not less than 2 <br />feet above that level. Our concern is that if <br />adequate water rights are unavailable or excessive <br />in cost, those reserves below the water table may <br />be unminable, reducing the property's mineral <br />value.
