"Is the application complete and accurate wit/t respect to groundwater depletion on <br />riparian communities, floodway locations, jloodway tnappittg, bald and golden eagle nesting <br />sites and pit dewatering?" (Rule 1.4.1(3)) <br />"The information in the applicant's application is incorrect. The app(icmrt was caught in <br />a lie about the affects of ground water on the riparian area and specifically the <br />cottwnvood forest. The applicant has been quoting infornurtion from well-known <br />sciernists, Dr. David Cooper & Dr. Michael Scott, on the effects of mining on riparimr <br />arms and the cottonwood forest. Dr. Cooper wrote to the County Commissioners <br />recently to state that although his information was being used, ii only represented r/> of <br />the story. He stated that the applicant's reports were "incomplete mrd not objective ". <br />(Van Norstrand; 4/5/01) <br />"the area wildlife has Trot been portrayed correctly in the Cnmilletti application. Bald <br />Eagles are 3/4 miles upstreunt, not 8 miles downstream as the applicant has said. The <br />Golden Engles are nesting less than 1/4 mile south of the mine site. (Landers; 6/14/01) <br />Division Response -The applicant has certified on page 7 of the Regulaz 112 Application form <br />(Item 4) that statements made in the application are being made under penalty of perjury and that <br />false statements made herein aze punishable as a Class 1 misdemeanor pursuant to Section 18-8- <br />503, C.R.S. The Division believes that based on all of the information provided by the applicant <br />during the permit review process that the application is complete and adequate [o meet the <br />
