A summary of the consumptive uses associated with the mining <br />operation is as follows: <br />Moisture Losses 8.8 acre-feet <br />Wash Water 1.0 acre-feet <br />Dust Control 2.9 acre-feet <br />Lake Evaporation 78.8 acre-feet <br />TOTAL ANNUAL WATER CONSUMPTION 91.5 acre-feet <br />Phased Consumation <br />Although the total demand for water will be 91.5 acre-feet, this <br />demand will not be realized until the project is substantially <br />complete. Lake evaporation is the only use that will continue <br />after the project is completed. The operator will reserve the <br />right to backfill portions of the mined areas to reduce the total <br />amount of lake acreage. <br />Water Rights <br />In the lease of the land from the property owner, the operator <br />has secured the use of one share of stock in the Brighton Ditch <br />Company. The yield of this share will adequately cover the water <br />consumption. <br />NPDES Permit and Water Quality <br />The proposed operation will not directly discharge to the South <br />Platte River. All wash waters that will be us d iinn th <br />processing portion of the project will be recycled an~ wiZl no€ <br />be discharged to the river. Since there is no direct discharge, <br />an NPDES Permit is not required for the operation. <br />The proposed operation is in conformance with Colorado State <br />Water Quality Regulations. There will be no adverse impacts to <br />surface or groundwater due to the mining operation. <br />U. S. Armv Corns of Engineers 404 Permit <br />The proposed operation is not located ih the stream channel of <br />the South Platte River. The operation does not plan to discharge <br />fill materials to waters of the U.S. Therefore, a 404 permit is <br />not required for this operation. <br />G-4 <br />
