It is the Rules and <br />Regulations adopted by the Mined Land Reclamation Board <br />on April 19, 1977, that the Commissioners are reluctant <br />to recognize. In 1978, the General Assembly disapproved <br />nearly all of those Rules and Regulations in Senate Joint <br />Resolution No. 3. In his opinion of April 19, 1978, the <br />Attorney General claims that Senate Joint Resolution No. 3 <br />was an unconstitutional act. however, it is very difficult <br />for a board of county commissioners to ignore any official <br />action of the General Assembly unless it is declared invalid <br />by a Court. <br />As stated above, the County is ready and willing to <br />comply with the 1976 Act and obtain any permits required by <br />it. <br />Yours truly, <br />~- <br />,, - , <br />Charles--B:-Berxly <br />Assistant County Attorney <br />/bk <br />cc: Board of County Commissioners <br />Max L.
