Cottony <br /> <br />RE:, Moffat County Road Department, Permit Application File No. M 2002-059 Acting Division Director <br />Sunbeam Pit #1 112 c Permit Application -Adequacy Review <br />Deaz Mr. Mack: <br />The Division has received your application for the Sunbeam Pit #1 112c Pemut. Listed below aze the Division's adequacy <br />review comments for this application. The Division is required to make a recommendation to the Mined Land Reclamation <br />Boazd no later than August 29, 2002 therefore, your response to the following adequacy review concerns should be <br />received by [he Division by August 22, 2002. <br />1. In Exhibit D page 2 it is stated [hat Moffat County may put an asphalt batch-plant onto the property for neighborhood <br />paving projects. Please describe [he measures which will be taken to prevent any contamination of surface or ground <br />waters from any spilled asphalt materials during the operation of [he batch plant. <br />2. A wildlife statement was included as Exhibit H-3. Item 4 of this statement states that "Impacts will be minimal <br />provided that the mining operation stays outside of the 100 year floodplain of the Yampa River." It appears from [he <br />application that this will be the case, please commit [o keeping the mining operations out of the flood plain. <br />3. Item 5 of the wildlife statement recommends [ha[ the seed mix be modified by replacing the intermediate wheatgrass <br />with bluebunch wheatgrass, slender wheatgrass, and/or needle and thread. <br />4. The Division concurs with this recommendation, and suggests that the intermediate wheatgrass be replaced with 2 <br />pounds Pure Live Seed (PLS) per acre of Needle-and-thread and 3 pounds PLS per acre of slender wheatgrass, The <br />Division recommends [hat [he applicant commit to this modification of the seed mix . <br />Pleased be advised [hat [he Sunbeam Pit #1 112 (c) Application maybe deemed inadequate, and the application may be <br />recommended for denial on August 29, 2002 unless the above mentioned adequacy review items aze addressed to [he <br />satisfaction of the Division. If you feel that more time is needed to complete your reply, the Division can grant an <br />extension to the decision date. This would be done upon receipt of a wri[tea waiver of your right to a decision by August <br />29, 2002 and a request for additional time. This must be received no later than the deadline date.
