vv, <br />I. <br />Mr. Donald Frick <br />2004 <br />Page 3 <br />February 18, <br />As part of the monthly accounting prepared by the operator, the location of the <br />discharge point or points from each dewatering trench must be located on a map <br />and submitted with the accounting. The SDF value and associated lagged effects <br />must be determined for each discharge point and recorded in the monthly <br />accounting form. The lagged effects associated with previous points of discharge <br />must also be tracked in the accounting along with the effects of current dewatering <br />points. <br />8. All water discharged from the pit and utilized to offset depletions caused by the pit <br />operation cannot be banked or credited to offset lagged depletions in subsequent <br />years. All discharges will be available to offset depletions in the year when <br />depletions are actually occurring. <br />9. The existing lease of replacement water dedicated to long term replacement, and <br />available for augmentation if it is deemed necessary, is evidenced by an <br />agreement with the City of Westminster dated May, 1998. All replacement water <br />must be concurrent with depletions in quantity, timing, and location. <br />10. Approval of this plan is for the purposes as stated herein. This office must first <br />approve any additional uses for which the water may be used. Any future <br />additional historic consumptive use credit given (e.g., agricultural water transfer) for <br />this site must consider all previous credits given. <br />11. All pumping for dust control and dewatering discharges to the South Platte river <br />shall be measured in a manner acceptable to the division engineer. <br />12. The replacement water that is the subject of this plan cannot be sold or leased to <br />any other entity. As a condition of subsequent renewals of this substitute water <br />supply plan, the replacement water must be appurtenant to this site until a plan for <br />augmentation is obtained. A copy of this approval letter should be recorded with <br />the County Clerk and Recorder. All replacement water must be concurrent with <br />depletions in quantity, timing, and locations. <br />13. Adequate accounting of depletions and replacement must be provided to the <br />Division Engineer in Greeley (810 9'" Street, 2nd Floor, Greeley, Colorado 80631, <br />970-352-8712) and the Water Commissioner (Robert Stahl, 9378 WCR 25, Fort <br />Lupton, Colorado 80621, 303-857-0742) on a monthly basis or other interval <br />acceptable to both of them. The accounting form provided with your application is <br />subject to modification and approval by the division engineer. All amounts shall be <br />in acre-feet. <br />14. The name, address, and phone number of a contact person who will be <br />responsible for the operation and accounting of this plan must be provided on the <br />accounting forms to the division engineer and water commissioner. <br />15. The approval of this substitute water supply plan does not relieve the Applicant <br />and/or landowner of the requirement to obtain a Water Court decree approving a <br />
