5/13/81 <br />placing said Release of record in Gunnison County, Colorado. <br />• Thereupon Reer shall be relieved of all obligations, erpresc oc <br />implied, of this Sublease, except for those obligations accrued <br />as of the effective date of surrender, for the payment of <br />royalties and taxes and reclamation and restoration of the <br />surface and removal of equipment, plant and machinery, as <br />required by federal, state and local laws, rules and <br />regulations. Upon such surrender Bear shall also convey by <br />quit claim deed to Anchor, at no cost to Anchor, any water <br />rights applied for by Bear or adjudicated to Bear in connection <br />with mining operations on the Property, and Bea[ shallexecute <br />a recordable release of this Sublease. <br />Article 7 - Manner of t?ining and Commencement of t?ining <br />Bear shall work, mine and remove mineable and <br />merchantable leased coal in the most effectual, workmanlike and <br />proper manner, by methods which are acceptable in the industry <br />and as may be necessary and appropriate, so as ultimately to <br />• recover the greatest amount of merchantable and mineable <br />subleased coal therefrom as reasonably possible. Bear shall <br />commence commercial mining operations on the Property within <br />eighteen (18) months from the date hereof, or this Sublease <br />will terminate. If Bear does so commence mining operations, <br />this Sublease shall thereafter terminate iE for any twelve (12) <br />month period Bear fails for any reason other than a focce <br />majeure, to conduct commercial mining operations either on the <br />Property or on adjacent lands, access to which lands is <br />obtained through or over the Property. <br />Article 8 - Pelf orm ance Under The Lease <br />Bear shall faithfully carry out all of the expressed <br />and implied undertakings of the Lease and shall abide by all <br />applicable laws and regulations.
