5/13/81 <br />• fixed amount per ton, in accordance with rules and regulations <br /> adopted from time to time by the Department of Interior or <br /> other United States agency having jurisdiction over the Lease. <br /> Payments of wheelage royalties to Anchor sha 11 be made at the <br /> same times as royalties for such coal are paid by Bear to the <br /> United States. Saheelage royalties sha 11 be credited against <br /> the minimum production payments provided in the Sublease, in <br /> the same manner that production payments are credited <br /> thereunder. <br /> 5. Anchor Cooperation Saith Bear. Anchor agcees to cooperate <br /> with Bear and assist Bear in the following respects, with the <br /> objective being to produce coal in the quickest, safest and <br /> most efficient manner possible and to that extent: <br /> Anchor shall, where permissible, assign to Bear <br /> all permits, permit applications and other <br /> governmental authorizations relative to coal mining <br />• operations pursuant to the Lease. Anchor shall also <br /> furnish Beac with all studies and back-up data to such <br /> materials, as well as all exploration data. Anchor <br /> has as of the date of this Agreement furnished Bear <br /> with all title information in its possession and <br /> control regarding the Roberts Property. Bear shall, <br /> however, be fully responsible for obtaining at its own <br /> cost and expense any further permits, bonds, approvals <br /> or authorizations necessary for operations on the <br /> properties subject to the Lease or on the Roberts <br /> Property. <br />6. Improvements. Bear may remove or destroy any <br />exis[ing improvements on the lands subject to the Lease or on <br />the Roberts Property, provided that such removal or destruction <br />does not violate the Lease and provided further that Bear shall <br />. pay Anchor the fair market value of any improvements so removed <br />or destroyed.
