It is af;reed as follows:
1. Atlantic shall sell to Lear and Bear shall
purchase from Atlantic the coal that fiear is
or will be obligated to sell and deliver to
Western Slope under Section 3.1 of the Purchase
Agreement.
2. The term of this Agreement shall be from
March 17, 1980 to and including December 31, 1981.
3. Bear shall deliver to ldestern Slope all coal
dclit~ered to it by Atlantic and Bcar shall
pa}• Atlantic for such coal all amounts that Bear
receives from Western Slope under the Purchase
Agreement. Payment by Bear [o Atlantic shall be
made iunnediatel}• upon receipt of payment frou~
Western Slope. Bear shall not be entitled to
retain any of the amounts it receives from Western
Slope under the Purchase Agreement, but the coal
sold to Bear under this Agreement shall be coal
delivered to a buyer under Section 4 of the Contract
to tfine Coal and Bear shall Yee paid for such coal
as provided in the Contract to Mine Coal. However,
if Western Slope does not pa}' Bear for coal pur-
chased by Western Slot>c, Bc,•:ir- shall not be en-
titled to par-ment for such coal under the Contract
ro Mine Coal.
