<br />2. The Mining Lease is currently valid and in <br />full force and effect. To the best of <br />Assignor's knowledge, default: has occurred <br />or been asserted under the Mining Lease and <br />no event has occurred that, with notice or <br />the passage of time or. both, miyht mature <br />into a default u~rder the Mining Lease. All <br />amounts due and payable to the lessors under <br />the Mining Lease have been paid in full. <br />The Mininy Lease has never been changed or <br />amended, except by that certain Amendment to <br />Mining Lease dated February 23, 1988. <br />3. To the best knowledye of Assignor, no <br />lawsuits, claims or demands gave been filed, <br />asserted or threatened with respect to the <br />Leasehold Interest or the right to <br />possession or operation of the real property <br />subject thereto. <br />9.
