Regular 112 Operation Reclamation Permit <br />Application; Permit Number M2004-051 / <br />Dear Mr. Squire: <br />This fine represents Wattenberg Improvement Association (the "Association"), anon-profit <br />corporation organized to provide a treated municipal water supply to its membership, which currently <br />comprises approximately one hundred homes in the town o£ Wattenberg, in Weld County. In June, <br />2004, Aggregate Industries -WCR, Inc. ("Aggregate") filed a Regular 112 Operation Reclamation <br />Permit Application for Wattenberg Lakes, in Weld County, permit number M-2004-051 (the <br />"Application"). Aggregate seeks to mine the Wattenberg Lakes property, which lies directly south of <br />the Association's community. Aggregate publishednotieeoftheApplicationintheBrightonStandard, <br />and according to my conversation with you on August 24, 2004, the last publication date was August <br />21, 2004. The Association believes that it may be directly and adversely affected by the proposed <br />e ,`- t! mining operation and would like to hereby submit written comments to the Application pursuant to Rnle <br />1.7.1 of the Division of Minerals and Geology (the "Division") Rules and Regulations. <br />The first concern the Association has is that the ]pining operation may adversely affect the water <br />levels of the well from which the Association provides the water supply to its members. As nearly as <br />the Association can determine from the information available, the Association Well is located within <br />six hundred feet of the boundary of Aggregate's property that will contain the Wattenberg pit. <br />Aggregate indicates in its Application that it plans to build slurry walls, which may or may not help <br />avoid injury to the well. Without more specific information, the Association has been unable to fully <br />analyze the impacts the Wattenberg pit operations and the slurry wall may have on this well. However, <br />due to the proximity of the mining operations, some impact on the well is likely.
