• 2.03.6 Riaht of Entry and Operation Information <br />The documents in Volume 4, Tab 1, Documents and Leases, <br />explains the Operators right to mine the coal in the <br />Federal Coal Leases and presents documentation of the <br />Operator's fee coal ownership. The documents in Exhibit <br />14, Tab 1, explain the Operators right to mine the coal <br />in Federal Coal Lease No. C-0117192. <br />The areas where the Operator currently has the right to <br />mine coal include: <br />Township 13 South, Range 90 West, 6th P,M. <br />Federal Coal Sublease D-052501 <br />Section 17: E~NE~d, SW4NE~6, SE; <br />Federal Coal Lease C-0117192 <br />Section 17: S~NW~6, SW~ <br />Section 18 : SE <NE ;, NE ;SE a <br />Federal Coal Lease COC57633 <br />Section 20: A parcel of land located in the N~ being <br />more particularly described by the documents presented in <br />Volume 4, Tab 1 <br />• Federal Coal Lease COC57632 <br />Section 16: A parcel of land located in the WAS being <br />more particularly described by the documents presented in <br />Volume 4, Tab 1 <br />Bear Fee Coal: <br />Section 18: SASE;, All of the coal in the B coal seam <br />occurring north of the stream bed of the Lone Pine <br />drainage, Gunnison County, Colorado. <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining <br />The permit areas are not within an area designated <br />unsuitable for surface mining activities as defined in <br />Rule 7 or 30 CFR 764 and 765, or under study for <br />designation in an administrative proceeding under Rule 7 <br />or 30 CFR 764 and 765. <br />Because the permit area is located within 300 feet of <br />several occupied dwellings in Somerset, Colorado, the <br />applicant has obtained a waiver from the individuals who <br />own or occupy these dwellings. These waivers are set <br />forth in Exhibit 2, Waivers from Owners or Occupants of <br />Dwellings Within 300 Feet of Permit Area. <br /> <br />2.03-15 Rev. 12-29-94 <br />
