Dept. of Natural Resources <br />The copy of your Application for a P9ining and Reclamation <br />Permit as required by the Colorado Alined Land Reclamation Act <br />was forwarded to this office and received August 1G, 1983. <br />Your proposed operations on the Cash Aline Dump unpatented lode <br />mining claim (CA7C 164304) fall within the purview of the Surface <br />Management Regulations found at 43 CFR 3809 (copy enclosed). <br />Since it appears that your proposed operations will disturh loss <br />than five acres of Public Land, submission of a Notice of Intent <br />pursuant to 43 CFR 3809.1-3 is required at least 15 clays prior to <br />commencing operations. An outline is also included for your <br />convenience. You may reference your 64LRB permit application <br />rather than repeat the information required in Parts IV, V and <br />VI of the outline. However, please note that the statement found <br />at 43 CFR 3809.1-3(c)(4) must be included as a part of your Notice. <br />I also wish to offer a few comments on your MLRB application. On <br />pages 4 and 5 a distinction is made between the owners of record <br />of surface land listed as 2 and 10. Please note that unpatented <br />mining claims are also Public Lands administered by the U.S. Bureau <br />of Land Management. A claimant has the right. to mine, remove and <br />sell all valuable mineral deposits within the claim boundaries <br />and to use as much of the surface as is necessary for mining <br />operations. Fee title, however, remains with the Federal Government <br />until patent issues. The correct address for the BLM Colorado <br />State Office as noted in 10 should be: 1037 20th Street, Denver, <br />CO 80202. The Northeast Resource Area is the o{'fice most directly <br />responsible Cor on-the-ground munagcmcnL of Public Lands in <br />Boulder County. You may direct further correspondence concerning <br />your proposed operations directly to us. The affidavit on page <br />19 attesting to Go 1d Iiill P9ining Company's fee ownership of the <br />Cash Aline Dump wipatented lode is incorrect for the reasons stated <br />above. The requirement for submission of a Notice of Intent under <br />the 3809 regulations should be included on page 20 as a necessary <br />permit even though approval of a Notice is not required. <br />
