Dept. of Natural Resources The copy of your Application for a P9ining and Reclamation Permit as required by the Colorado Alined Land Reclamation Act was forwarded to this office and received August 1G, 1983. Your proposed operations on the Cash Aline Dump unpatented lode mining claim (CA7C 164304) fall within the purview of the Surface Management Regulations found at 43 CFR 3809 (copy enclosed). Since it appears that your proposed operations will disturh loss than five acres of Public Land, submission of a Notice of Intent pursuant to 43 CFR 3809.1-3 is required at least 15 clays prior to commencing operations. An outline is also included for your convenience. You may reference your 64LRB permit application rather than repeat the information required in Parts IV, V and VI of the outline. However, please note that the statement found at 43 CFR 3809.1-3(c)(4) must be included as a part of your Notice. I also wish to offer a few comments on your MLRB application. On pages 4 and 5 a distinction is made between the owners of record of surface land listed as 2 and 10. Please note that unpatented mining claims are also Public Lands administered by the U.S. Bureau of Land Management. A claimant has the right. to mine, remove and sell all valuable mineral deposits within the claim boundaries and to use as much of the surface as is necessary for mining operations. Fee title, however, remains with the Federal Government until patent issues. The correct address for the BLM Colorado State Office as noted in 10 should be: 1037 20th Street, Denver, CO 80202. The affidavit on page 19 attesting to Go 1d Iiill P9ining Company's fee ownership of the Cash Aline Dump wipatented lode is incorrect for the reasons stated above. The requirement for submission of a Notice of Intent under the 3809 regulations should be included on page 20 as a necessary permit even though approval of a Notice is not required.
