Drainage -This will be operated as a dry pit with no effect on the historic drainage pattern. A <br />Stomrwater Dischazge Permit will be acquired for the site. <br />9. Vehicular access will be south off St. Charles Road. <br />10. The following additional permits will be acquired: <br />a. Mined Land Reclamation Board 112 Permit <br />b. Water Quality Control Division Stormwater Dischazge Permit <br />a Colorado Air Pollution Control Division Fugitive Dust Permit <br />The Plo[ Plan and Vicinity Map sho+v the location of the subject property. The A-1 Zone District, <br />Uses by Review Section, provides for "Natural Deposits Extraction and Processing." <br />Section 36 -adjustment (f) appeal for a Special Use Permit provides: "Before granting an appeal for <br />a Special Use, the Planning Commission shall find in writing, based upon evidence and testimony, <br />that all of the following conditions do, in fact, exist:" <br />(1) "The requested use is listed as a Special Use in which the parcel is located." <br />As stated in the preceding pazagraph, the requested use is provided for in the A-1 Zone District. <br />as "Natural Deposits, Extraction and Processing." <br />(2) "The granting of the Special Use Appeal will not substantially modify the Land Use Plan <br />or the intent, purposes and spirit of this resolution." <br />The applicant does not feel that this Special use will substantially modify the Land Use Pla,i or its <br />intent or purpose. The site partially surrounds or adjoins the Lessors' dairy operation, and is <br />presently used for hay or equipment storage. There aze other mining activities in the immediate area, <br />+vith the balance of the land being either crop production or grazing. The above uses will continue <br />after extraction. <br />(3) "The Special Use proposal incorporates means to create an environment harmonious with <br />that of the surrounding properties." <br />This operation will be monitored by various state agencies, including the Mined Land Reclamation <br />Board - Division of Minerals and Geology, [he Air Pollution ConVOI Division and the Water Quality <br />Control Division - both of the Colorado Department of Health, to insure environmental harmony and <br />compliance. <br />
