<br />RESOLUTION, USR-978 <br />83rd Joint Venture Resource <br />Page 3 <br />e. the Use by Special Review will not cause injury to vested or <br />conditional water rights as set forth in Section 44.4.11 of <br />the Weld County Zoning Ordinance. <br />4. Prior to scheduling before the Board of County Commissioners: <br />a. an off-site road improvements agreement shall be submitted to <br />the Department of Planning Services staff and Weld County <br />Engineering. The agreement shall mitigate impacts generated <br />on Weld County roads by this mining operation. The agreement <br />shall include the type of road improvements, the applicant's <br />share of the improvements, means of financing, time frame for <br />construction and a proposal to dedicate an additional 10 feet <br />of right-or-way along the south side of the property. <br />b. the applicant shall submit a screening plan to the Department <br />of Planning Services for review and approval. The plan shall <br />include a proposal for secured entrances. <br />c. The plat shall be amended to include a note stating: <br />- "The Mined Land Reclamation Board has the <br />authority to issue permits for mining and <br />reclamation activities. Activities <br />related to mining and reclamation are, <br />therefore, under the jurisdiction of the <br />Mined Land Reclamation.
