RE: Mundell Estate No. 32 Pit (File M-95-019) 2nd Adequacy Letter
Dear Mr. Miller:
As a result of your FAX response dated April 14, 1995, the Division
understands that Baca County waives its right to a decision on the
above referenced application within 30 days of submittal, ie. by
April 13, 1995, and wishes to continue the Division's review.
Since the Fax response dated April 14, 1995 involves changes or
additions to the application, pursuant to Rule 1.8, this letter is
to notify the county that a new decision date of April 28 has been
established for the application in order that the following
documentation be provided:
1) Evidence, as required by Rule 1.8, that the changes or
additions made in the application by the FAX response were
also added to the copy of the application on file for public
review with the County Clerk and Recorder.
2) Evidence of the publication of notice of the application in
a newspaper of general circulation as required by Rule 1.6.2
(1) (c). (A copy of the notice to be published was included in
the permit application, but evidence that it was published as
required has not been provided.)
3) A signed and notarized Performance Warranty, the need for
which was indicated in the Division's first adequacy review of
the application for the Mundell Estate No. 32 Pit.
