Simpson, P.E. <br />BG[e Engineer <br />CONDITIONS FOR APPROVAL <br />^ The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground <br />water must not occur during or afrer mining operations. <br />® The proposed operation will consume ground water by: ^ evaporation, ®dust control, ^ <br />reclamation, ^ water removed in the mined product, ^ processing, ^ other:. <br />^ Prior to approving a well permit, the applicant must conduct a field inspection of the site and <br />document the locations of all wells within 600 feet of the permit area. The applicant must then <br />obtain a waiver of objection from all well owners with wells within 600 feet of the permit area or <br />request a hearing before the State Engineer. <br />^ Other: <br />COMMENTS: Applicant states that Ranch Land, LLC water rights will be used to supply dust control <br />water. Prior to approval of this application, the applicant must quantify the amount of water required for <br />dust control and a substitute water supply plan pursuant to House Bill 1414 (attached) must be in place to <br />use the water for dust control. <br />Applicant has stated that Red Creek, which runs through the project site, is typically dry except for spring <br />runoff and storm events. Any water ponded in an excavation must be released to the natural stream system <br />within 72 hours, or all work must cease until a substitute water supply plan, or augmentation plan approved <br />by water court, is obtained to account for the ponded stormwater. Reclamation plans must ensure that <br />stormwater will not remain ponded for more than 72 hours. <br />
