SUPPLEMENTARY RELATIONS ~II IIIIIIIIIIIII ~II • <br />Q) Sand and Gravel Pits, Washing and Crushing <br />No such use shall be permitted unless the following standards <br />and conditions exist or are met: <br />a. That it is designed, located and proposed to be operated <br />i so that it will not be injurious to the neighborhood <br />in which it shall be located or otherwise determental <br />to the public welfare. <br />J b. When the application is filed to the Mesa County Planning <br />Commission (See Supplementary Regulations, Section XIX-T.) <br />~ the applicant shall provide a plan showing the land <br />i form which the sand and gravel will be excavated. This <br />) plan shall show the contours of the land on at least <br />five (5) feet contour intervals, any improvements thereon <br />~ and to a distance of three hundred (300) feet in all <br />~ directions from the subject. <br />c. No excavation or processing of sand or gravel shall be <br />permitted nearer than thirty (30) feet to the boundary of <br />adjacent property, not nearer than one hundred twenty five <br />(125) feet to any existing residence, unless the owner <br />or owners of such adjacent property consent in writing <br />to a lesser distance. The Commission may set a greater <br />distance than above mentioned, when in their opinion <br />it is justified. <br />d. The Commission shall specify the distance from any public <br />structures when excavations are made in or near stream <br />beds. When excavations are near or adjacent to irrigation <br />~ canals or ditches, the applicant shall secure a written <br />consent from the Ditch Company or from officials responsible <br />1 for the canals or ditches, indicating their determination <br />J as to setbacks from such canals and ditches. The Com- <br />mission shall consult with the County Raod Department <br />. as to setbacks from public rights-of-way when excavation <br />is contemplated near such rights-of-way. <br />1 e. The applicant shall agree to leave the excavated area <br />in such condition as may be required by the Commission. <br />In establishing such requirements, the Commission shall <br />l take into consideration the following factors: <br />.J (1) The degree of hazard to the public. <br />J (2) The health of the general public, e.g., mosquito <br />hazard by stagnant ponds. <br />(3) The feasibility of leveling the excavated area. <br />(4) The feasibility of restoring topsoil, if any, to <br />the premises. <br />78 <br />
