Endangered Species Act, National Historic Preservation Act, and Environmeutal <br />Justice. The FS conditions ensure compliance of the proposed Dry Fork CEL with <br />provisions of the Endangered Species Act, based on conclusions in the BA and USFWS <br />concurrence, as described above under "Extraordinary Circumstances". In compliance <br />with the National Historic Preservation Act, cultural surveys have been completed and <br />SHPO has concurred that no historic properties will be affected. It has also been <br />determined that floodplains, wetlands, and prime farm lands will not be affected. Finally, <br />there are no low income or minority populations that could be disproportionately affected <br />by the FS conditions to be attached to the Dry Fork CEL. Additional information about <br />all these resources is in the project file. <br />Road Use. In accordance with Title 36 CFR Part 261.54(d), all commercial users of <br />Forest Service System roads are require to obtain a Road Use Permit (RUP). MCC will <br />be required to obtain a RUP for NFSR 711 and NFSR 711.3b. Maintenance of existing <br />roads, as well as construction of new temporary roads (to drill site EEE), will be <br />constructed to Forest Service standards (per Condition #4, Appendix A). <br />Under WO Interim Directive 1920-2004-1[FSM 1925.04b (1) (c)], effective July 16, <br />2004, when a forest does not have aforest-wide roads analysis incorporated in its <br />management plan, the Regional Forester must serve as the responsible official for any <br />road construction in an inventoried roadless azea when a road is needed in conjunction <br />with any mineral lease, license, permit, or approval issued for mineral leasing operations. <br />Consequently, the Regional Forester is the deciding official for the FS conditions to be <br />attached to the Dry Fork CEL. <br />IMPLEMENTATION DATE <br />This decision is effective the date of signature below.
