Long <br />Division Director <br />~ <br />RE: Ferrero pit (File M-2000-028) Results of Division review of applicant's March 21, 2000 adequacy response <br />Dear Mr. Lewicki: <br />The Division has conducted a review of your response to the initial adequacy review of the permit application for <br />the Ferrero Pit. The response, together with telephone contact by Keith Vanderhorst of the SEO, essentially <br />satisfies all adequacy issues previously identified by the Division. There is, however, one remaining adequacy <br />concern the Division requests you address. That concern is listed below: <br />REVISED PAGE 23: In the earlier adequacy review, the Division failed to note and, therefore, failed to <br />mention that the rates proposed for the seed mix are identified in the narrative line immediately above the species <br />listing as "rates for broadcast seeding:" while in the narrative line just below the species listing, the rates are <br />indicated to be "for drill seeding,". The revised Page 23 continues to carry this inconsistency. <br />Since the SCS recommendations for seeding rates N Appendix A are cleazly for drill seeding, the Division <br />requesu that a second revision of Page 23 be made in which reference to the proposed seed rates are consistently <br />identified as being applicable to seeding by means of a drill. <br />With submittal of a revised Page 23, all adequacy issues will be satisfied and approval of the application can be <br />made. With submittal of a Financial Warranty in the proposed amount of $13,887.00, in a form acceptable to the <br />Division, a permit for the Ferrero can be issued. <br />NOTE: If for some reason, you cannot respond by the April 7, 2000 decision date for this application, please <br />provide a written waiver of your right to a decision on that date in order that the permitting process be allowed to <br />continue. As indicated previously, approval of the application can not be given until all adequacy issues are <br />satisfactorily addressed.
