Burden of Proof Requirements <br />The permittee has the burden of proof when eeelong relief from total suspended solids (TSS), total iron and/or settleable <br />solids (SS) limimtion. Outfalls 001, 002, 003, 005, 006, 007, 008, 009, 025 and 028 are eligible for relief. The remaining <br />permitted outfalls are not eligible. <br />Relief may be.grsnted for each discharge occurrence only whm necessary and shall sot be granted when the permittee has <br />control over the discharge. The permittee should endeavor to meet the primary limitations whenever possible. The <br />• permittee will need to show that exoeedeace of the applicable limitations was catraed by precipiation and no other aotrrce and <br />that the discharge was beyond their control. <br />a) For rainfall. to waive TSS and total iron limitation, it is necessary to prove that discharge occumd within 48 hoots <br />after +~+'ae~*ahle precipitation has stopped. In addition, to waive settleable solids limitation, it is neaswy to prove that <br />discharge occurred within 48 hours after procipitatioa greater than the 10-year, 24-hour event has stopped. <br />b) For saowmelt, to waive TSS and total iron limitation, it is necessary to prove that discharge occurmd within 48 hours <br />after pond inflow has stopped. In addidotr,. to waive seWeable solids limitation, it is necessary to prove that discharge <br />occurrod within 48 hours after pond inflow volume grater than the 10-year, 24-hour event has stopped. <br />Should a precipitation event or snowmelt occur, the permittee shall submit adequate proof in order for as exemption to be <br />claimed. Said proof shall be submitted as an nffnrt•mrnt t0 the Discharge Monitoring Repoli (DMR) for the appropriate <br />period. The Division shall determine the adequacy of proof. As paR of this detarminatioa, the Division shall evainte <br />whether the permittee could Nava controlled the discharge in such a manner that primary ]imitation could have bees met. <br />All manual dewateriag of the ponds shall meet TSS sad total iron limitation. <br />3. Post-Minin¢ Areas <br />Commencing at the time active mining has ceased and surface areas have been teturned to the required contour all applicable <br />discharges may be eligible for limitation other than tfu~se spxified in PaAs I.A.2. and I.A.3. These port-mining limitations <br />shall remain in effect until bond rolease.
