RE: Bear Mine Technical Revision - Boundary Extension

Dear Mr. Bear:

The Division has received your application for a technical revision
to add 10.7 acres to the existing permit boundary for the Bear No. 3.
The application is deemed complete as of this date. It is the responsibility
of Bear Coal Company to place the notice of ownership, precise location,
• and boundaries of land to be affected in a local newspaper as required by
Rule 2.07.3(2), except that only one time publication is required. The
publication must contain all of the information required by Rule 2.07.2(2).
Public copy of the application must be filed in the local courthouse at the
same time as the newspaper notice.
Furthermore, the Division has reviewed the Technical Revision application
for technical adequacy end proposes to approve the application. The proposed
decision is attached. It is the responsibility of Bear Coal Company to
publish the proposed decision one time in a local newspaper.
Due to the fact that the technical revision will entail additional surface
disturbance, appropriate surety will have to be submitted before the proposed
decision becomes final. Based on costs of ripping, grading, topsoiling,
seeding and mulching 2.1 acres of surface disturbance, a surety of $2,000.00
was calculated.
