Cottony <br />, Division Director <br /> Natural Resource Tnlstee <br />Re: Possible Prospect in Chaffee County within Permit Boundary of Permit M-1992-045. <br />Deaz Mr. Van Ella: <br />The Division of Minerals and Geology has received yow request to file for a Notice of Intent to Conduct Prospecting <br />(NOI) within the Gold Basin permit area and to forward any documents and fees in question. I have enclosed a NOI form <br />for yow use. However, the Division of Minerals and Geology believes that it is not appropriate to file for a NOI on the <br />azea proposed because the area in question is already within the boundaries of the approved permit azea and that any <br />prospecting activities within that permit area are part of the mining operations (Sections 34-32-113(1.5), (4), (8), and <br />(12)). The statute and regulations establish that prospecting is before development; development is before mining; <br />and, once mining is being performed, any prospecting and/or development work falls within mining activities allowed <br />by an approved mining and reclamation permit. <br />In addition, you stated, in the last amendment, that you would not distwb the azea that you are now proposing to <br />distwb. Therefore, please revise yow present permit to allow distwbance in this area including submitting a new map <br />to show this distwbance and posting a bond to cover the reclamation cost prior to any new distwbance in the area. <br />After you revise your permit, you may then go ahead and prospect on the mine permit area. This type of revision to <br />yow permit can usually be handled as a technical revision and does not require any fee. However, the Division <br />always reserves the light to determine whether an application to revise a permit is a technical revision or amendment <br />until after we receive the application and have reviewed the proposed activifies. <br />If you have any questions, please contact me at (303) 866-3863 or write to me at the above address. <br />Si erely, <br />~° <br />Carl B.
