BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />PRE-HEARING ORDER <br />IN THE MATTER SEIFERT CONSTRUCTION, BOYER'S PIT, FILE NO. M-2002-122, <br />CONSIDERATION OF A 112 PERMIT APPLICATION OVER OBJECTIONS <br />This Pre-hearing Order is proposed to the Mined Land Reclamation Boazd ("the Boazd") by the <br />Pre-hearing Conference Officer, Sandra Brown, to govern the hearing in this matter. This Order, <br />and amendments thereto, if any, shall be effective upon approval by the Boazd. If any party has <br />objections to the provisions of this Pre-heazing Order, those objections must be raised at the final <br />hearing before the Board during its deliberations under Section VI.1 below. <br />I. FORMAL PUBLIC HEARING <br />The Formal Public Heazing on this matter (unless noticed otherwise) shall be held before the <br />Boazd on May 28-29 at the Centennial Building, 1313 Sherman Street, Denver, Colorado, 80203, <br />Room 318, during the Board's regulaz May meeting. The Boazd's agenda (unless noticed <br />otherwise) will begin at 10:00 a.m. on Wednesday and at 9:00 a.m. on Thursday. <br />II. PARTIES <br />This matter comes before the Mined Land Reclamation Boazd as a proposed Pre-hearing order by <br />the Board's designated Pre-heazing conference officer, Sandra Brown. The Pre-hearing <br />Conference in this matter was held April 10, 2003, in Westcliffe, Colorado. The Pre-hearing <br />Conference Officer verified the following parry list: <br />Jerald A.
