<br />Gentlemen:
<br />Pursuant to the rules and regulations of the Colorado Mined
<br />Land Reclamation Board and the "Colorado Mined Land Reclamation
<br />Act" of 1976, H. B. No. 1065, The Denver and Rio Grande Western
<br />Railroad Company has been given notice by the Whitewater-Building
<br />Materials Corporation, address 940 South 10th Street, Grand
<br />Junction, Colorado, 81501, that they have applied to the Colorado
<br />Mined Land Reclamation Board for an application to conduct a
<br />surface mining operation for sand and gravel on lands located
<br />in part of Sections 14 and 15, Township 2 South, Range 1 East,
<br />Ute Meridian, and part of Sections 28 and 29, Township 12 South,
<br />Range 99 West, 6th P. M., Mesa County, Colorado.
<br />Because our Railroad Company tracks between Grand Junction and
<br />Delta, Colorado, more or less splits the Whitewater Corporation
<br />properties in and through the above-referenced sections, may we
<br />respectfully request that when the Colorado Mined Land Reclama-
<br />tion Board meets to consider the subject application, that the
<br />following conditions set forth in this letter be incorporated
<br />in the proceeding, and that the actual granting of the applica-
<br />tion be made subject to the following conditions so that the
<br />mining operation will not adversely affect our track and right-of-
<br />way as provided in Section 34-32-115 (4)(d), House Bill 1065.
