MURRAY, being first duly sworn upon oath, deposes <br />and says: <br />1. He is the Vice-President of Lakewood Brick and Tile <br />Company, a Colorado corporation, and is empowered to act for <br />and on behalf of said corporation in all respects in connec- <br />tion with any applications, petitions, contracts, correspondence, <br />reclamation bonds, or other activities with or before the Mined, <br />Land Reclamation Board under the provisions of the Colorado <br />Mined Land Reclamation Act. <br />2. The mineral rights and the right to mine the minerals <br />on the subject property are owned by Marcus F. Church. Lake- <br />wood Brick and Tile Company mines the property under a lease <br />agreement with Marcus F. Church. The lease is available for <br />inspection at the office of the corporation in Lakewood, <br />Colorado. <br />3. The corporation is legally empowered to enter upon <br />the subject lands and to conduct its mining operations for <br />clay. <br />James R.
