MINING PERMIT - MINERALS OTHER THAN LQOAL Permit date November 13 la 81 Permit No.81-228 (Anniversary date for Annual Report and Fee purposes) THIS PERMIT is issued by the Mined Land Reclamation Hoard, Department of Natural °.e sources, Mate of Colorado. RECITALS A. Varra Companies, Inc. ("operator") desires Co conduct a mining operation known as GRAVEL PLANT NO. 3 for the purpose of extractinS ado raoate 8. On 1981 the Mined Land Reclamaition Board ("the board" approved operator's application for [his permit, fixed the amount of bond and direcCed that this permit be issued upon the filing with the Mined Land Reclamation Givisicr, ("the division") of bond in the amount so fixed in form and substance approved by the division, and such band has been so furnished. C. On November 13 1981 the board made the following findings: the application for this permit complies with the requiremenCS of Che Colorado Mined Land Reclamation Act;, C.R.S. 19?3, 34-32-101 et se as amended ("the Act") and with all applicable local, state and federal laws; 2. the operation will not adversely affect the stability of any significant, valuable, and permanent man-made structure located wiChin Cwo hundred feet of the affected land, except where there is an agreement between oper- ator and the persons having an interest in the struc- ture that- damage to the structure is to be compensated for by operator; and 3• the proposed mining and reclamation operations can b~: carried out in conformance with the recuirements or the Act. 0. Operator has made a showing satisfactory to the board: (I) [ha[ it swill employ, during and after its underground mining and surface operations, procedures reasonably designed to minimize, as much as practicable. environmental disturb~• once `rpm such operation; (2) that it wiil prcvide for reclamation of the affected lands appropriate to the ;ubsa~• quent beneficial use of such lands; and (3) that, in th=_ av>_nt of the failure of its proposed reclamation plan,~it swill take ~,~hatever measures may be necessary to assure the success of reclamation of the lands affected by such opera- tions in accordance with C.R.S. 1?73, 34-32-101 et sap.
