Davis <br />1390 Ash Street <br />Denver, Colorado 80220 <br />Re: Notice of Intent No. X-87-202-00, Drill Hole Abandonment Report and Final <br />Reclamation Report <br />Dear Mr. Davis: <br />The above referenced reports have been reviewed. Both are acceptable to the⢠<br />Division, although some questions arise from the Drill Hole Abandonment Report <br />in regard to Drill Hole No. 8. I interpret the report on this hole to <br />indicate a TD of 90 feet, the top of a water bearing zone at a depth of <br />75 feet, and cement plugs to have been placed between depths of 3 feet and <br />10 feet and between depths of 65 feet and 90 feet in the hole. Rule 4.07.3(2) <br />of the Regulations of the Colorado tdined Land Reclamation Board for Coal <br />Mining requires the sealing of water bearing zones not exhibiting artesian <br />flow at the surface with solid cement or other suitable media extending <br />20 feet above and below the zone. Accordingly if the top of the water bearing <br />zone was at 75 feet, the hole should have been sealed with cement or other <br />media up to a depth of 55 feet. The questions the Division has, therefore, <br />are 1). was the water level in the hole or the top of the water bearing zone <br />at 75 feet and 2). were drill cuttings or some other material used to fill <br />the hole between depths of 10 feet and 65 feet? <br />Sincerely, <br />Javrtpo C ~`~va <br />James C.
