Cottony <br />Division Director <br />Natural Resource Trustee <br />On August 2, 2004, DMG determined the above referenced application complete for the purposes <br />of filing. Pursuant to Construction Materials Rule 1.4.6(1), DMG's decision date for the application <br />has been set for September 1, 2004. Please be advised that the application may be deemed <br />inadequate, and the application may be denied on September 1, 2004, unless the following <br />adequacy review items are addressed to the satisfaction of the DMG. <br />The application states that surface and subsurface rights are controlled by the BLM. The <br />applicant has demonstrated right to enter for 1.5 acres through BLM permit COC <br />065720. Correspondence from the BLM, dated August 5, 2004 and received August 16, <br />2004, reiterates that the applicant has right to enter for only 1.5 acres. However, the <br />permit boundary includes 9.3 acres. Therefore, the application does not demonstrate <br />right to enter for 8.1 acres of the permit area. Pursuant to Construction Materials Rule <br />6.3.7, the application must provide the basis for legal right of entry to the site. Please <br />revise all applicable portions of the permit application to include only those areas for <br />which the applicant can demonstrate right to enter. <br />2. The mine plan map, Exhibit E3, and reclamation plan map, Exhibit E4, were not signed <br />arid dated as required under Construction Materials Rule 6.2.1(2)(b) and (c). Please <br />submit new maps, which satisfy the minimum requirements of Rule 6.2.1. <br />3.' Pursuant fo Rule 1.6.2(1)(g), please provide proof of publication of the public notice <br />required under Rule 1.6.2(1)(d). <br />Pursuant to Rule 1.4.1(9), the decision deadline for the application, September 1, 2004, may be <br />extended at the request of the applicant. Should the applicant require additional time to resolve <br />the adequacy issues identified in this letter, please ensure that DMG receives a written request for <br />extension prior to the September 1, 2004 decision date. <br />Office of Office of Colorado <br />
