Whereas, the lessee is <br />desirous of obtaining the right to enter upon <br />said land and to take there from said stone, gravel, <br />sand or soil for the purpose herein stated and <br />privileged to enter upon said land for the <br />hereinabove stated purposes. <br />It is further agreed that the lessor does hereby <br />sell to lessee all of the stone, gravel, sand <br />or soil which said lessee may remove from said <br />parcel of land from the date hereof until the <br />date July 1, 1989, at price of$.30 per cubic <br />yard, giving and granting lessee the right to enter <br />upon said parcel of land for the removal of said <br />material and to erect or construct thereon such <br />machinery and equipment as in the judgement of the <br />lessee is necessary and proper to extract and remove <br />from the said land and or process the material <br />herein purchased, and the further right to enter <br />upon said parcel of land to remove any such <br />equipment, machinery or structures placed thereon <br />by lessee. <br />It is further agreed by and between parties hereto <br />that the lessee shall have the right to haul the <br />material taken from said parcel of land, across <br />any land owned by the lessor or routes mutually <br />agreeable to the parties hereto. <br />ADDITIONAL CONDITIONS: <br />1. Premises will be left in a neat condition. All <br />trash and waste materials will be removed from <br />site. <br />2. Bases of measurement for payment will be as <br />follows: <br />By survey cross sections before and after <br />construction. <br />
