If any future operation or activity which could adversely affect the <br />peregrine falcon or bald eagle is undertaken, the Division and local wildlife <br />authorities will be contacted so that specific measures can be developed <br />to prevent such an impact. <br />All powertines and distribution lines used for or incidental to mining <br />operations on the permit area will be constructed in accordance with <br />Suggested Practices for Raptor Protection on Power Lines -the State of <br />the Art in 1981. Power poles will utilize perch guards shown on Figure 16- <br />1. Clearance to utilize perch guards was granted by the U.S.D.I. Fish <br />and Wildlife Service and concurred by the State of Colorado, Division of <br />wildlife in June of 1982. Referto Figures 16-2 and 16-3. Ground wire <br />modification recommendations witl be followed. <br />(3) Protection of Hydrologic Balance -See Tab Sections 17, 18, and 19. <br />(4) Island Acres Recreation Area is located across the river and north of the <br />Unit Train Loadout. The park is included in the land shown on Exhibit 3, <br />Tab Section 3, as being owned by the State of Colorado in Section 23, <br />T.10S:, R.98W., 6PM. Based on the location of the public park with <br />respect to the nearest mine surface facility and the function of that facility <br />(Unit Train Loadout), the probability of any impact to the park due to <br />surface operations is minimal. <br />The park is separated from planned underground mining operations by <br />the Colorado River on the west and by Interstate Highway 70 on the east. <br />Since underground mining will not extend beneath the river or the <br />highway, the park will be unaffected by underground operations. <br />There are no public parks or places listed on the National Register of <br />Historic Places in the Roadside North and South Portals permit area or <br />adjacent area. See Appendix 5-4. <br />Maps locating sites within the mine plan area are available in the <br />Colorado Historic Preservation Office. After reviewing Powderhom Coal <br />Companys mine plan, the State Historic Preservation Officer (SHPO) <br />determined that "there will be no effect to cultural resources". <br />16-3 (Rev. 9/06) <br />
