Long <br />Grand Junction, Colorado 81501-2668 Division Director <br />Re: D Road Gravel Pit, Application No. M-2002-046, Conditional Use Permit (CUP). <br />Deaz Ronnie: <br />This Office has received The City of Grand Junction's letter concerning the laps of the CUP for the <br />above referenced site. The decision date for this application is June 10 , 2002. Based on the fact that <br />there has been no objections received to date it appears as if the decision date will stand. This will be <br />well before the June 25s', 2002 Planning Commission Meeting. If objections aze received, the decision <br />date would be pushed back to July 10~', 2002. Construction Rules and Regulations require that all <br />Local, State and Federal permits be annlied for, but not necessarily issued, for staff to make a decision <br />on a permit application. However, the Rules state that all Local, State and Federal permits must be in <br />place before the operation can begin. If Ephemeral Resources were to begin any operations on site prior <br />to the City's issuance of the CUP, they would be in violation of the Rules and subject to a Mined Land <br />Reclamation Board hearing with possible civil penalties and possible permit termination.
