Simpson, Assistant State Engineer <br />SUBJECT: Robert D. and Beverly R, hfiller - Miller Gravel Pit, 82-112, <br />Application for Mining and Reclamation Permit <br />As requested, we have reviewed the above referenced application for a new gravel <br />pit near Elizabeth. The application states that after mining operations are com- <br />plete, there may be 3 to S acres of low area covered by 2 inches to 3 feet of <br />water. The water in this low area will be used for washing and perhaps other <br />mining purposes and wil:i be reclaimed for wildlife. We need to know the source <br />of this on-site water. Since the water will be beneficially used and this <br />operation is located in a river basin which is over-appropriated, the appli- <br />cant must have a senior water right in order to have a dependable water supply <br />source, Otherwise, the a)~plicant must develop an augmentation plan to allow <br />the use of a junior water right when it is subject to administration. The <br />water right used by the applicant must be adjudicated for both industrial <br />and wildlife purposes. <br />The application states ghat ground water will not be exposed by the operation. <br />IVe would like to see drill logs or other pertinent information to ascertain for <br />ourselves the level of the ground water table in the mining area. If the source <br />of water for the low area is ground water, the applicant will also need a <br />well permit as required by CRS 1973, 37-90-137. <br />Until we receive answers to our inquiries and we are satisfied that this pit <br />will operate in compliance with Colorado Water Statutes, we cannot recommend <br />approval of this application. Further, we will order Miller Pit to cease <br />operations if we find they are exposing ground water or collecting water out- <br />of-priority in the low area of the pit. <br />HDS/JRH:pkr <br />cc: Jim Clark, Div.
