SHEITON Director
March 8, 1982
United Farm Agency
245 U.S. Highway 50 East
Salida, Colorado 81201
Attention: Mr. Jim [datson
RE: Hart Rok Redi Mixt Concrete, Inc. - File nos. 77-195, 77-196, 6 77-197
Dear P1r. [/a is on:
As per your request, I am sending you (as the agent of Hart Rok Redi Pli xt
Concrete, Inc.) the following items: 1) the General Letter of Credit from
the First National Bank of Salida in the amount of $10,500.00 dated November
16, 1977; 2) one copy of the permit application for the Fiain Plant Pit,
file no. 77-197; 3) 3 copies of our "RECLAMATION BOND - CORPORATE SURET]"'
form; and 9) 3 copies of our "REQUEST FOR TRANSFER OF PERMIT AND SUCCESSION
OF OPERATORS" form.
As I understand it, the business and properties are to be sold and another
operator will succeed to the permits after they are issued. Each permit
application was approved by the Mined Land Reclamation Board with bond set
at $2,500.00. Therefore, each corporate surety should be made out for this
amount. If you have any questions concerning these forms, please ca 11 me.
As soon as the bonds for the three operations have been received and approved
by our Division, the permits will be issued to Hart Rok Redi Ffixt Concrete.
As a part of this process, please review the permit for file no. 77-197
and update the map to reflect the new acreage of 9.8 acres.
As soon as the three pez'mits have been issued, succession of operators may
then occur on them. The forms mentioned under number 4) above should be
properly filled out for each of the three operations and submitted to our
Division. The Board will then consider these requests duriny their next
regularly-scheduled meeting. (The next two meetings will be March 29-25 and
April 21-22.) Rt that time, I will also plan to recommend that the bond
for each operation be raised to $5,000.00 (the newly legislated maximum bond
for limited impact operations). Thus, the new operator will be required to
submit three 55,000.00 bonds in order to succeed to the three permits (if
the Board approves the raises in bond).
I think this summarizes this situation. However, if you require any further
clarification in this matter, please call me.
Sincerely,
hla rk S.
