<br />Mr. Steve Shuey <br />Division of Minerals & Geology <br />Durango Field Office <br />March 24, 1995 <br />Page 5 <br />All areas of the mine site are subject to the requirements of the Stormwater Discharge Permit issued <br />by the Colorado Department of Public Health and Environment. As discussed earlier, this permit <br />requires the development of a Stormwater Management Plan (SWMP) which incorporates many <br />Best Management Practices (BMPs) into the day to day activities at the site. Inspection of the <br />BMP's is required by the permit on asemi-annual basis and daily monitoring is strongly suggested. <br />Excess sediment loads leaving the site will not be allowed by the discharge permit. Measures will be <br />taken to assure that the operation will remain in compliance of all environmental laws governing the <br />site. <br />Mr. Sherman asked if the lower area of the mining operation could retain the existing vegetative <br />cover. The lower side of the mining permit is the location of the old railroad grade and the <br />hydropower conduit. This area does not currently have much vegetative cover as it has been and is <br />used for vehicular access. The area immediately west of the mining permit is vegetated to varying <br />degrees, all the way down the slope to the Lake Fork of the San Miguel River. This vegetative <br />buffer, which is owned by the applicant, will not be disturbed by the mining operation. <br />The type and application rate of the mulch to be used in the hydromulching operation will be <br />determined by the contractor selected to do the reclamation revegetation work. They will be <br />required to contact the local office of the SCS for recommendations. <br />We hope this information adequately addresses all the concerns and comments you presented in your <br />adequacy review.
