RE: SHPO/CHS Condition/s(\~to Permits
Effective immediately, we will no longer condition permits or
revisions to permits to require proof of Colorado Historical Society
(CHS) clearance prior to disturbance of a permitted area. Based on
AGO Formal Opinion No. 95-1 regarding the need to attach cultural
resource survey stipulations to reclamation permits for mines on
private property, it has been determined that a portion of the CHS
regulations are an incorrect interpretation of the statute (if you
would like to see a copy of this opinion, see Carl Mount).
From this date forward, we shall provide the Colorado Historica
Society, a.k.a. SHPO the following information:
1. Notice of a pending application.
2. Date by which DMG must make a decision.
3. Surface land ownership (whether federal, state, or private).
4. If a 111 application, a copy of the contract.
If you have any pending applications, or have issued any permits since
1991 and the operator has not fulfilled the historic resource survey
stipulation, please notify the operator. The operator should contact
the CHS to determine if the survey is still required. If the operator
>s not required to con uc e survey, ey must get a letter from the
CHS stating this, the letter will fulfill the stipulation requirement,
and DMG will remove the stipulation from the permit. ,
