Long <br />Division Director <br />The Division has conducted a preliminary adequacy review of the <br />Pathfinder Pit application. The following comments and concerns <br />are the result of that review. Please respond to these concerns in <br />a timely manner so that a decision can be rendered by the <br />application decision due date which is March"27, 1995. <br />PERMIT APPLICATION <br />Please ensure that all maps and drawings are signed by qualified <br />personnel as required by Rule 6.2.1(2)(b). <br />The first page of the application package states that the permitted <br />area equals 14.75 acres. The Plan View Map indicates an area of <br />12.95 acres. The mining plan calls for a maximum disturbance of <br />8.3 acres. Please clarify these discrepancies and revise the <br />appropriate application contents. <br />PUBLIC NOTIFICATION <br />Because Highway 145 is within 200 feet of the proposed disturbed <br />area, please send notification to the Colorado Department of <br />Transportation pursuant to Rule 1.6.2(1)(d)(ii). <br />Please send a copy of the final disposition of the State Historic <br />Preservation Office regarding the old railroad bed as soon as it is <br />available. The Division cannot approve this application without <br />SHPO clearance. <br />PRB-MINING AND MINING PLAN MAPS <br />Please indicate, on the Appendix C maps, the location and extent of <br />the wetlands and small pond described in the surface water section <br />of Hxhibit G. <br />The application states that the hydropower conduit is not within <br />the area of active mining, but is within 200 feet of the limit of <br />mining. The Mining Plan and Reclamation Plan Maps show the conduit <br />within the area to be mined. Please clarify this situation and <br />revise either the maps or the text accordingly. <br />
