<br />5 <br /> <br />2.03.6 Right of Entry and Operation Information <br />• <br />(1) The permit area covers the following lands (See Figure 2.03-1): <br />T.SN, R.78W, 6th P.M. <br />Sec. 10: SEA/. NEB/. NEB/.. Contains 10 acres <br />Sec. 11: W~/x NWT/~ Contains 80 acres <br />See 2: Beginning at the point 1225 feet N 89°47'21" E from the NW corner of the SWY., <br />Section 2, thence N 39°47'21" E, 700 feet, thence S 00°12'39" E, 1500 feet, thence Southwest to <br />a point on the South section line which is 1530 feet S 89°33'00" E of the SW corner of the said <br />SW~/., thence N 89°38'00" W, 1530 feet to the S~V corner of said SW~/., thence N 00°01'03" W, 300 <br />feet, thence N 40°44'00' E, 1250 feet, thence NE to the point of beginning. Contains b5 acres. <br />Slurco bases its legal rights to enter and continue surface mining operations in Sections 10 and 11 on <br />o`~ <br />the federal land on Coal Lease C-27931 (see Exhibit 3L). The lease was executed March 20, 1980. <br />The right to enter Section 2 is granted in a private lease which is contained in Exhibit M. <br />(2) The federal government owns both' mineral and surface estate on federal lease C-27913. <br />• (3) This subsection doesn't apply to Slurco because it is addressed to the regulatory authority. <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining <br />(1) The Bureau of Land Management prepared Em~ironmental Assessment No. CO-010-31-53 on Pit #2 <br />of the permit area (Appendix H of the original application). The BLM found the tract suitable for <br />leasing (Appendix I o[ the original application). <br />The Bureau of Land Danagement prepared an Environmental Analysis, No. CO-010-9-183 on Pic #1 <br />of the subject lands. Based on that unsuitability study, the BLM found [he land suitable for leasing <br />(see Appendix H, page 30 of the original application). More speci[ically, the mine area is not <br />incompatible with existing state or local land use plans, nor does the area affect historic lands, <br />renewable resource lands, or natural hazard lands. <br />• <br />(2) No[ applicable to Slurco discussions since the proposed permit area has been deemed suitable for <br />mining. <br />-11- (Revised 7/10/91) <br />Iti~ti°Igl <br />
