• PLEASE READ <br />PENALTIES POR NOT COMPLYING WITH A NC7fICE OF VIOLATION <br />OR CESSATION ORDER <br />The Surface Mining Control and Reclamation Act of 197) <br />provides for heavy penalties for failure to comply with a <br />notice of violation or a cessation order within the time set <br />for abatement. Please read this carefully so you can avoid <br />these penal*~es. <br />Mandatory Penalties <br />The Act requires a penalty of not less than 5750 per day <br />for each violation which you fail to correct on time. This <br />penalty must be assessed for each day from the date set for <br />abatement in the notice or order until you have corrected <br />the violation. This minimum $750 per day penalty is in <br />addition to any penalty you may be assessed for the violation <br />contained in the notice or order. Thus, by failing to <br />correct a violation on time, you may be assessed two separate <br />penalties. <br /> The minimum $750/day penalty can run up quickly to a <br /> very large amount. If you miss the abatement date for only <br /> one violation by only 10 days, the penalty will be at least <br />• 57,500. Because each violation in a notice or ord er is <br /> treated a_s a separate notice or order for purposes of this <br /> penalty, this amount would mult ip y by the number of <br /> violations. <br />Other Penalties <br />In addition to the re wired enalties, you may be subject <br />to the fol owing actzon if you do not correct the violation: <br />1. You may be served with a cessation order requiring <br />you to stop mining immediately. <br />2. The Office of Surface Mining may seek a court order <br />to close your operation. Violation of a court order is <br />contempt of court, and can lead to imprisonment. <br />3. The Office of Surface Mining may refer your case for <br />criminal prosecution, which could subject you to a maximum <br />sentence of up to 510,000 or one year in prison or both. <br />4. Your permit to mine may be suspended for a period of <br />time or revoked. <br />
