The Applicant's commitment to blasting according to the `Blasting Level Chart" with initial <br />blasts in accordance with the "Scaled Distance Equation" does not appropriately protect the light <br />fixtures, the equipment or sensors at the Plant, or the downstream users and consumers of the Plant's <br />effluent, and does not demonstrate that the mining plan will prevent harm to off-site structures. All <br />of the references and resources used by the Applicant and the DMG to justify the Applicant's <br />blasting plans apply a safety threshold for blast vibrations that is proven to protect dry watt structures <br />or plaster on lathe construction. The Applicant has failed to meet its burden of demonstrating <br />whether these thresholds aze sufficient to prevent harm to the sensitive processes, equipment and <br />instrumentation in the light fixtures and at the Plant. Therefore, the Boazd may deny the permit <br />pursuant to C.R.S. § 34-32.5-115(4)(e). <br />As such, the City insists that, should the application be approved, further studies - <br />customized and adapted to address the nature of the receptors aze issue here rather than dry wall <br />construction -are required in order to comply with C.M.R. 6.5(4) and in order to understand the <br />exact impact that blasting at the proposed quany site will have on the operation ofthe light poles, the <br />Plant and the quality of the Plant's effluent. Moreover, in order to protect the City, the Black Hawk- <br />Central City Sanitation District, and the Silver Dollar Metropolitan District, the Applicant should be <br />required to conduct a baseline pre-blast survey of the Plant and light poles and to obtain a notarized <br />agreements among the Applicant, the Black Hawk-Central City Sanitation District, and the City of <br />Black Hawk and between the Applicant and the Silver Dollaz Metropolitan District, in which the <br />Applicant agrees to provide full compensation by the Applicant for any damage caused by blasting to <br />the continuous, safe, and compliant operations of the respective entity's operations.
