RESPONSE: Empire Energy Corporation will cooperate with making
• geophysical log information available to the CMLRD whenever
possible.
8. Outcrop Barriers page 2.05.3.7
Any revision for daylighting will need to be a technical revision
due to subsidence and sediment control concerns. Such a submittal
would need approval prior to extracting coal closer than 100 feet
of the subcrop.
RESPONSE: Page 2,05.3-7 has been revised to address this issue,
9. Bonding
The Division has reviewed the bond cost summary submitted on
October 7, 1986. In general, the submittal is well organized, and
addresses the Division's requirements for supplying construction
specifications for structures. The unit costs seem conservative,
and are acceptable to the Division. THe most recent bond
calculation by the Division, which is dated May 23, 1986 and
utilized the Division's draft bond calculation handbook, indicated
that the bond is sufficient.
However, no costs were included to revegetate, if necessary, the
Utah Tract area. These fioures should be submitted.
RESPONSE: Exhibit 25, Reclamation Bond, pages i, ix, and 28, have
been revised to address this issue.

39-19
