4. Rule 2.04.6(2) Geology Description Underground Mining
•
a. Empire has included some thickness figures for the "E" Coat Seam on
Cross Sections A-A", B-B", and C-C" (Maps 7A, 7B, 7C). There is
however, no map of the "E" Seam specifically to show nature, depth
or thickness. The bulk of the mining tc '~e done under the permit
being sought is from this seam. Empire should, at a minimum,
provide a tabulation of "E" Seam depths, thicknesses and control
points similar to Table 8, page 2.04.6-14, in which data for the
"F" Seam appears. An isopach map of the "E" Seam would be
desirable as well.
RESPONSE: Pages 2.04.6-18 and 2.04.6-19 have been revised, Map 8A,
"E" Seam Bottom Structure has been added and Map 7, Geology has
been revised to address these issues.

b. It is not clear that analvses of samples of the roof and floor
materials for Seam "E" have been provided as required. Part 1 of
Exhibit 9 is titled "Roof and Floor Chemical Analysis "E" and "F"
Coal Seams, but the analyses pertaining to each are not indicated.
On page 2.04.6-24, the text under Geochemistry of Coal and Burden
Materials says "Chemistry of Associated Roof and Floor Materials of
the "F" Coal Seam are presented in Exhibit 9." The next paragraph
says Empire Energy "has not" obtained similar samples from roof and
floor of "F" and "E" Coal Seams. The question as to whether
analvses of the roof and floor materials have been provided for
Coal Seam "E" should be resolved. If such are included in Part 1
of Exhibit 9 they should be specifically identified.
RESPONSE: Page 2.04.6-24 and Exhibit 9 have been revised to
address this issue.
r
39-8
